Terms of Service

[REVIEW BY COUNSEL] This document is a working draft. It describes how SpotWeave actually works, but the wording is not legal advice and must be reviewed and approved by a qualified lawyer before launch. Passages we are least certain about are marked inline.

1. Who you are agreeing with

These terms are between you and Stralion Pty Ltd (“Stralion”, “we”, “us”), ABN 76 115 789 234, registered office PO BOX 277, Gosford NSW 2250, Australia. They cover the SpotWeave apps for Android and iOS, the web companion at app.spotweave.app, and this website. By using SpotWeave you accept these terms; if you do not accept them, please do not use it.

Our Privacy Policy explains what we collect and why, and forms part of this agreement.

2. What SpotWeave is

SpotWeave is a field notebook for your map: you save Spots (a place, with a name, notes and photos), group them into SpotSets, download map regions for offline use, and — if you choose — publish a SpotSet to the community so others can browse, follow it and contribute Spots of their own.

We may add, change or remove features. If we remove something you rely on, we will try to give reasonable notice and, where the data is yours, a way to get it out.

3. Your account

You can use SpotWeave locally without an account. To sync across devices or use community features you need one.

  • Give accurate information and keep your sign-in credentials to yourself.
  • You are responsible for activity under your account.
  • You must be at least 16 years old to create an account. [REVIEW BY COUNSEL] — must match the age threshold in the privacy policy and the store age ratings.
  • Tell us at support@spotweave.app if you think your account has been compromised.

4. Your content

Your Spots stay yours. You own what you create; nothing here transfers ownership.

To run the service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, transmit, adapt (for example, resizing a photo or generating a thumbnail) and display your content — strictly for the purpose of operating and improving SpotWeave for you.

When you publish a SpotSet to the community, you additionally grant every other SpotWeave user a non-exclusive, royalty-free licence to view, download for offline use, and — where the set allows contributions — build on that content within SpotWeave. This is what makes a Community SpotSet useful, and it has a consequence worth understanding: once other people have downloaded a community set, unpublishing or deleting it does not remove their copies. Publish accordingly.

You promise that you have the right to publish what you publish, and that it does not infringe anyone else’s rights.

5. Rules of the road

Do not use SpotWeave to:

  • publish someone’s home, workplace or whereabouts without their consent, or otherwise harass, endanger, stalk or dox anyone;
  • publish content that is unlawful, hateful, sexually explicit, or that promotes harm;
  • publish locations whose disclosure is illegal or reckless — protected archaeological or cultural heritage sites, restricted or hazardous areas, sites protected under environmental law, or the nests and dens of protected species;
  • infringe copyright, trade marks or other rights;
  • misrepresent locations, publish deliberately false or dangerous route or access information, or spam the community;
  • scrape, bulk-extract or resell community content, or attempt to break, overload or circumvent our security, rate limits or paid features.

6. Moderation

Published community content can be reviewed. Our moderators — staff and trusted community reviewers (“Rangers”) — may hide a comment, take down a Spot or a photo, freeze or unpublish a SpotSet, and suspend or ban an account that breaks these rules. We aim to act proportionately and, where it is practical and appropriate, to tell you what happened and why.

Reports can be filed from inside the app. Filing a knowingly false report is itself a breach of these terms. If you believe we got a decision wrong, email support@spotweave.app.

Moderation is best-effort, not a guarantee: we do not pre-approve community content, and we cannot promise that everything published by other users is accurate, lawful or safe.

7. Outdoors safety and accuracy — read this one

SpotWeave is a notebook, not a navigation system, and not a safety device.

  • Locations are user-generated. Spots, notes, routes-of-access and photos in Community SpotSets are created by other people. They can be wrong, out of date, mislabelled, or placed by someone who never went there. We do not verify them.
  • Maps and coordinates are approximate. Basemap data comes from OpenStreetMap contributors via Protomaps and carries their errors; GPS accuracy varies with terrain, weather and hardware; offline map regions are snapshots that age.
  • You are responsible for your own trip. Before you go, verify access rights and land ownership, legality (permits, closures, private property, protected areas), conditions (weather, tides, fire and flood danger) and your own capability and equipment. Carry an independent means of navigation and a way to call for help.
  • Do not rely on SpotWeave in an emergency. It does not send distress signals, does not work as a locator beacon, and offers no routing, hazard warnings or rescue service. In an emergency, call your local emergency number.
  • Follow the law and leave no trace. Respect closures, cultural sites, private land and wildlife.

To the extent the law allows, you use SpotWeave and any community content at your own risk.

8. Paid features

SpotWeave is free to start. Pro features, when they ship, are sold only as in-app purchases through the Apple App Store and Google Play.

  • There is no checkout on this website or in the web companion, and we will never ask you for card details.
  • Apple or Google is the merchant of record for your purchase. Billing, renewal, price changes, restores, refunds and cancellation are handled under their terms, in their account settings — not by us. We can help you find the right screen, but we cannot process a store refund on your behalf.
  • Subscriptions renew automatically until you cancel through the store.
  • Free-tier limits may change over time; we will not retroactively lock content you already created behind a paywall.

9. Our intellectual property

SpotWeave’s software, name, logo, design and content (other than yours and other users’) belong to Stralion Pty Ltd and its licensors. These terms do not grant you any right to use our brand. Map data is © OpenStreetMap contributors, used under the Open Database Licence, with basemaps built by Protomaps — attribution appears in the app’s map view. Open-source components remain under their own licences.

10. Availability

We aim for SpotWeave to be there when you need it — including when you have no signal, which is why your device holds the primary copy of your data. Even so, the service is provided as is and as available: we do not promise uninterrupted operation, and sync, community features and photo storage depend on third parties. Keep your own backups of anything irreplaceable.

11. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law; for major failures you are entitled to a replacement or refund and to compensation for reasonably foreseeable loss or damage.

Where liability can lawfully be limited, and to the maximum extent permitted by law:

  • we exclude all other warranties and conditions, express or implied;
  • we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, data or goodwill;
  • we are not liable for loss or injury arising from your reliance on user-generated locations or content, or from your decisions in the field (see section 7);
  • our total aggregate liability is limited, at our option, to resupplying the service or paying the cost of having it resupplied, or otherwise to the amount you paid us for SpotWeave in the 12 months before the claim.

[REVIEW BY COUNSEL] — this entire section, and in particular the liability cap, the outdoors disclaimer’s enforceability against the ACL’s non-excludable guarantees, and the interaction with the professional-standards scheme statement printed in the site footer.

12. Suspension and termination

You can stop using SpotWeave at any time, and delete your account yourself in the app (You tab → Delete account — see the Privacy Policy for what that does and does not remove). We may suspend or terminate access if you materially breach these terms — immediately where the breach risks harm to others, otherwise with notice and, where sensible, a chance to fix it. Sections 4 (licences you granted for already-published content), 7, 9, 11 and 13 survive termination.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you use SpotWeave from somewhere else, you are responsible for complying with your local law. 14. Changes to these terms

We will post updated terms on this page and change the date at the top. Material changes get notice in the app or by email before they take effect. Continuing to use SpotWeave after that means you accept the new terms.
